I have attended many Trust study days learning about and updating on details of the Mental Capacity Act (MCA) as part of mandatory training. It wasn’t until I developed a role as an Advance Care Planning Advocate that I realised how much was missing from all the study days I have attended.

Basics of the were always covered, but specific detail on Lasting Power of Attorney and Advance Decisions to Refuse Treatment was always missing; this leaves Trusts and staff vulnerable due to lack of staff knowledge and understanding. 

Attending the Court of Protection provided me with insight into the harm that can be caused when teams fail to understand  legal frameworks; I wrote Reflecting on Re MW and Advance Planning: Legal frameworks and why they matter to help raise awareness and understanding.


“As a Registered Nurse, I have completed mandatory Mental Capacity Act (MCA) Training since the Mental Capacity Act was introduced in 2005. I have worked in a number of different NHS organisations and Trusts and draw on experiences from them all. Training invariably included awareness of Lasting Power of Attorney has been gained through professional curiosity and my role as a Lasting Power of Attorney Consultant.”

I set out to improve professional understanding and now provide education including:

  • The different type of Lasting Power of Attorney and the implications for care

  • How to support a patient who wishes to create an Advance Decision to Refuse Treatment

  • How to have compassionate DNACPR conversations and comply with legal frameworks

Education packages range from 1 hour to a complete day and can be tailored to organisational requirement.
