What type of information we have  

We currently collect and process the following information: 

  • Personal identifiers, contacts and characteristics (for example, name and contact details)

  • Form responses

  • Date of Birth 

  • Address 

  • Email 

  • Telephone number 

  • Payment details, eg debit card details (after discussion with you) 


How we get the information and why we have it 

Your information is collected in a way the law allows. 

Information is collected by your completion of the Lasting Power of Attorney Template  document, and by record keeping collated during our discussions and meetings. The  information is collected from verbal discussion and your completion.

Most of the personal information we process is provided to us directly by you for the  following reason: 

  • To contact you by phone or email to discuss your enquiry relation to service  provided by Speak For Me LPA 

  •  In order to draft your Lasting Power of Attorney (LPA) 

  • In order to meet any presentation or education enquiry you make 

  •  In order to gain feedback to improve the service Speak For Me LPA delivers 

  • Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for  processing this information are: 

    • (a) Your consent. You are able to remove your consent at any time. You can do this by  contacting clare@cfullerconsultancy.co.uk 

    • (b) We have a contractual obligation. 


What we do with the information we have 

We use the information that you have given us in order to send you information about  Speak For Me LPA services. 

We use the information that you have given us in order to draft your Lasting Power of  Attorney document. 

Once an LPAs is drafted and you wish to proceed to registration we share this information  with the Office of the Public Guardian (OPG) to fulfil the legal obligation of registering an  LPA: 

  • (c) We have a legal obligation. 


How we store your information  

Your information is securely stored on a password protected site. Any hard copies of  information are stored at the address above. 

We keep the details you have given (name, date of birth, address, contacts, phone number,  email, debit card) to draft the LPA until they are processed by the OPG. Any information  collected (name, date of birth, address, contacts, phone number, email, debit card) will be  kept until we receive confirmation that your LPA has been registered with the OPG. This can  take up to 13 weeks. Should you decide to withdraw the application we will delete/shred  your data. We keep a record of your name and email in order to collate feedback from your  experience of the service, we delete the drafts generated to submit your LPA to the OPG, we delete any emails generated with the OPG to submit your LPA. We ask your consent to  send you information that may be relevant to you. 


Your data protection rights 

Under data protection law, you have rights including: 

  • Your right of access - You have the right to ask us for copies of your personal information.  

  • Your right to rectification - You have the right to ask us to rectify information you think is  inaccurate. You also have the right to ask us to complete information you think is  incomplete.  

  • Your right to erasure - You have the right to ask us to erase your personal information in  certain circumstances.  

  • Your right to restriction of processing - You have the right to ask us to restrict the  processing of your information in certain circumstances.  

  • Your right to object to processing - You have the the right to object to the processing of  your personal data in certain circumstances. 

  • Your right to data portability - You have the right to ask that we transfer the information  you gave us to another organisation, or to you, in certain circumstances. 

You are not required to pay any charge for exercising your rights. If you make a request, we  have one month to respond to you.
